Đối với lĩnh vực nghiên cứu, các “innovation” cũng có khả năng tạo ra giá trị gia tăng rất đáng kể, nhất là khi phương pháp được cải thiện. Ở một mức độ nhỏ nhưng sâu hơn, và cũng hiếm hơn, đó (...) là thay đổi/bổ sung về phương diện “khái niệm”. Hiếm là bởi không mấy khi ta có nhu cầu cải tiến một “khái niệm”. Đó là tiền đề sâu xa của những thông tin và thảo luận xây trên đó. Nếu cải tiến, bổ sung, hệ quả khá chắc chắn là có thể phải xới tung một trật tự logic của lập luận, cũng như gây ra thay đổi các khái niệm liên quan mật thiết. Luật số 70/2014/QH13 sửa đổi, bổ sung một số điều của Luật Thuế tiêu thụ đặc biệt (TTĐB) đã quy định lộ trình tăng thuế suất thuế TTĐB đối với thuốc lá từ ngày 01/01/2016 tăng từ 65% lên 70%; từ ngày 01/01/2019 tăng từ 70% lên 75%. Tuy nhiên, mức thuế suất 75% vẫn chưa thực sự phù hợp do chưa có tác động đủ mạnh để làm giảm lượng tiêu thụ thuốc lá. Vì vậy, trong thời gian (...) tới, Việt Nam cần điều chỉnh thuế suất thuế TTĐB đối với thuốc lá phù hợp với thông lệ quốc tế tốt và để đạt được mục tiêu giảm lượng người hút thuốc lá. Bằng cách sử dụng mô hình đo lường độ co giãn của cầu thuốc lá theo giá thuốc lá, từ đó làm căn cứ tính toán tác động đến nguồn thu ngân sách nhà nước (NSNN), kết hợp với các phân tích định tính, bài viết này đưa ra một số phương án điều chỉnh thuế suất thuế TTĐB đối với thuốc lá; đồng thời đánh giá tác động đến thu NSNN của Việt Nam giai đoạn 2026-2030. Đầu tư gián tiếp nước ngoài (FPI) có vai trò quan trọng đối với nền kinh tế nói chung, cũng như tăng trưởng kinh tế nói riêng. Để bổ sung sự thiếu hụt về nguồn vốn trong nước, thúc đẩy phát triển sản xuất, kích thích tăng trưởng kinh tế, giải quyết việc làm và cải thiện đời sống của người dân, thì thu hút đầu tư nước ngoài là một nhiệm vụ quan trọng đối với các nước đang (...) phát triển như Việt Nam. Bài viết làm rõ các tác động tích cực, cũng như những hạn chế của FPI đối với tăng trưởng kinh tế ở Việt Nam thời gian qua. Từ đó, đề xuất các giải pháp để tận dụng những tác động tích cực và hạn chế những rủi ro tiềm ẩn cho nền kinh tế trong việc thu hút FPI đối với tăng trưởng kinh tế Việt Nam. (shrink)

Recently, several philosophers have argued that, when faced with moral uncertainty, we ought to choose the option with the maximal expected choiceworthiness (MEC). This view has been challenged on the grounds that it is implausibly demanding. In response, those who endorse MEC have argued that we should take into account the all-things-considered choiceworthiness of our options when determining the maximally choiceworthy option. In this paper, I argue that this gives rise to another problem: for the most part, acts that we (...) consider to be supererogatory are rendered impermissible, and acts that we consider to be suberogatory are rendered obligatory, under MEC. This problem arises because, when we factor in prudential reasons, we often have most reason, or most expected reason, to act in accordance with our interests. I suggest a way to reformulate MEC so that prudential reasons only make acts permissible or non-obligatory, without ever making acts obligatory or wrong under moral uncertainty. (shrink)

This essay analyses the Confucian conception of xin, an attribute that broadly resembles what we would ordinarily call trustworthiness. More specifically, it provides an analysis of the psychology of someone who is xin and highlights a feature of the Confucian conception of trustworthiness: the trustworthy person has to ensure that there is a match between her self-presentation and the way she is. My goal is not to argue against any of the existing accounts of trustworthiness but to draw on Confucian (...) insights so as to shed light on features of trustworthiness that are overlooked in current discussions. I hope to show that the Confucian conception of trustworthiness puts more emphasis on the way a trustworthy person actively tries to make sure another’s dependency on her is not unwarranted than on how the trustworthy person responds to the one who gives trust. Conventionalists hold that the sorts of events that one survives—such as teletransportation, or a brain transplant—is at least partly determined by our attitudes. But if Conventionalism is true, whose attitudes directly determine whether one survives? Do the individual's attitudes do all the work as Private Conventionalists hold, or do the community's attitudes also factor in as Public Conventionalists hold? There has recently been a greater push towards Private Conventionalism, while explicit arguments for Public Conventionalism are difficult to come by. The Growing Block Theory of time says that the metaphysical openness of the future should be understood in terms of there not being any future objects or events. But in a series of works, Ross Cameron, Elizabeth Barnes, and Robbie Williams have developed a competing view that understands metaphysical openness in terms of it being indeterminate whether there exist future objects or events. I argue that the three reasons they give for preferring their account are not compelling. And since the (...) notion of “indeterminate existence” suffers conceptual problems, the Growing Block is the preferable view. (shrink)

There has been a growing charge that perdurantism—with its bloated ontology of very person-like objects that coincide persons—implies the repugnant conclusion that we are morally obliged to be feckless. I argue that this charge critically overlooks the epistemic situation—what I call the ‘veil of ignorance’—that perdurantists find themselves in. Though the veil of ignorance still requires an alteration of our commonsense understanding of the demands on action, I argue for two conclusions. The first is that the alteration that is required (...) isn’t a moral one, but rather an alteration of prudential reasoning. Second, and more importantly, this alteration isn’t necessarily a repugnant one. In fact, given that it prudentially pushes one towards greater impartiality, it may be seen as a point in favor of perdurantism. (shrink)

Dualism about possible worlds says that merely possible worlds aren’t concrete objects, but the actual world is concrete. This view seems to be the natural one for ersatzers about merely possible worlds to take; yet one is hard-pressed to find any defenders of it in contemporary modal metaphysics. The main reason is that Dualism struggles with the issue of how merely possible worlds could have been actual. I explain that there are two different Dualist strategies that can be taken to (...) address the problem. Furthermore, one or other of these strategies should be plausible to anyone who accepts both Existentialism—which tells us that the existence of singular propositions depends on what they directly refer to—and Serious Actualism—which tells us that things must exist in order to instantiate properties. Although an inverse relationship between religion and deviance is empirically well-established in the western context, previous studies on Islam and deviance conducted in non-western countries are limited. To address this gap in deviance research, we hypothesized that individual religiosity would be inversely related to deviance with the inverse relationship being more likely for ascetic than anti-ascetic or secular deviance. To test this hypothesis, we applied ordinary least squares and logistic regression methods to analyze data collected from 2,005 survey participants of (...) a Turkish public university student population. Regression results provided partial support for the hypothesis, as we found that religiosity was inversely related to both ascetic and secular deviance. The observed inverse relationship is noteworthy in that it was found in an institutionally secular, Muslim country. Implications of our findings are discussed. (shrink)

This article offers a novel solution to the problem of material constitution: by including non-concrete objects among the parts of material objects, we can avoid having a statue and its constituent piece of clay composed of all the same proper parts. Non-concrete objects—objects that aren’t concrete, but possibly are—have been used in defense of the claim that everything necessarily exists. But the account offered shows that non-concreta are independently useful in other domains as well. The resulting view falls under a (...) ‘nonmaterial partist’ class of views that includes, in particular, Laurie Paul’s and Kathrin Koslicki’s constitution views; ones where material objects have properties or structures as parts respectively. The article gives reasons for preferring the non-concretist solution over these other non-material partist views and defends it against objections. (shrink)

The idea that God creates out of Himself seems quite attractive. Many find great appeal in holding that a temporally finite universe must have a cause, but I think there’s also great appeal in holding that there’s pre-existent stuff out of which that universe is created—and what could that stuff be but part of God? Though attractive, the idea of creation ex deo hasn’t been taken seriously by theistic philosophers. Perhaps this is because it seems too vague—‘could anything enlightening be (...) said about what those parts are?’—or objectionable—‘wouldn’t creating out of those parts lessen or destroy God?’ Drawing from Stephen Kosslyn and Michael Tye’s work on the ontology of mental images, I respond to the above questions by developing a theory on which God creates the universe out of His mental imagery. Existentialism claims that propositions that directly refer to individuals depend on those individuals for their existence. I argue for two points regarding Existentialism. First, I argue that recent accounts of Existentialism run into difficulties accommodating the possibility of there being a lonely alien electron. This problem is distinct from one of the better-known alien problems—concerning iterated modal properties of aliens—and can’t be solved using a standard response to the iterated case. Second, though the lonely alien electron problem might seem to (...) be reason to reject the sort of Existentialist view at hand, there’s a plausible way to preserve the view: accept the existence of possible worlds that directly refer to individuals that don’t exist in those worlds. Such a solution might seem incompatible with Existentialism, but I show that Existentialists can avoid the incompatibility and should find the resulting view plausible. (shrink)

ABSTRACT I motivate ‘Origin Conventionalism’—the view that which facts about one’s origins are essential to one’s existence depends partly on our person-directed attitudes. One important upshot is that the view offers a novel and attractive solution to the Nonidentity Problem. That problem typically assumes that the sperm-egg pair from which a person originates is essential to that person’s existence; in which case, for many future persons that come into existence under adverse conditions, had those conditions not been realized, the individuals (...) wouldn’t have existed. This is problematic because it delivers the counter-intuitive conclusion that it’s not wrong to bring about such adverse conditions since they don’t harm anyone. Origin Conventionalism, in contrast, holds that whether a person’s sperm-egg origin is essential to their existence depends on their person-directed attitudes. I argue that this provides a unique and attractive way of preserving the intuition that the actions in the ‘nonidentity cases’ are morally wrong because of the potential harm done to the individuals in question. Many Perdurantists have been drawn to the “Conventionalist” idea that our person-directed attitudes can determine whether or not we survive events such as teletransportation. In this paper, I suggest a novel “Contextualist Conventionalism” according to which Conventionalism is true with respect to some, but not all, contexts in which we ask “will I survive?”—instead in “reflexive” contexts, “I” reflexively refers to a thinker whose persistence conditions are mind-independent. Unlike one form of Conventionalism which implies that the reference of “I” is (...) never constrained to reflexively referring to the thinker, Contextualist Conventionalism instead implies that there are some important contexts where the “I” is so constrained. And unlike another form of Conventionalism that secures such reflexive reference by holding that the survival of the thinker is a mind-dependent matter, Contextualist Conventionalism secures reflexive reference while avoiding such a radical metaphysical commitment. There has been a growing worry that perdurantism—and similarly ontologically abundant views—is morally untenable. For perdurantism posits that, coinciding with persons, are person-like objects, and giving them their moral due seems to require giving up prudentially driven self-sacrifice. One way to avoid this charge is to adopt consequentialism. But Mark Johnston has argued that the marriage of consequentialism and perdurantism is in moral trouble. For, depending on the nature of time, consequentialist perdurantists either are unable to do more than one (...) good act or they are morally obliged to adopt a repugnant form of ageism. I argue both that perdurantist consequentialism doesn’t have the latter implication, and that there’s at least one plausible form of consequentialism that perdurantists can adopt to avoid the former implication. The Zhuangzi 莊子 depicts persons as surviving their deaths through the natural transformations of the world into very different forms—such as roosters, cart-wheels, rat livers, and so on. It is common to interpret these passages metaphorically. In this essay, however, I suggest employing a “Conventionalist” view of persons that says whether a person survives some event is not merely determined by the world, but is partly determined by our own attitudes. On this reading, Zhuangzi’s many teachings urging us to embrace (...) transformation are not merely a psychological aid for dealing with death, but also serve as a tool for literally surviving it. Presentism says that only present objects exist. But the view has trouble grounding past-tensed truths like “dinosaurs existed”. Standard Eternalism grounds those truths by positing the existence of past objects—like dinosaurs. But Standard Eternalism conflicts with the intuition that there is genuine change—the intuition that there once were dinosaurs and no longer are any. I offer a novel theory of time—‘The Imprint’—that does a better job preserving both the grounding and genuine change intuitions. The Imprint says that the past and (...) present exist, but where the present exhibits mass-energy, the past only consists of curved empty regions of spacetime. We therefore avoid saying that there are dinosaurs, since there is no mass-energy in the past; but the curvature of the past gives us a way to ground the truth that “dinosaurs existed”. (shrink)

This chapter examines the possibility of using AI technologies to improve human moral reasoning and decision-making, especially in the context of purchasing and consumer decisions. We characterize such AI technologies as artificial ethics assistants (AEAs). We focus on just one part of the AI-aided moral improvement question: the case of the individual who wants to improve their morality, where what constitutes an improvement is evaluated by the individual’s own values. We distinguish three broad areas in which an individual might think (...) their own moral reasoning and decision-making could be improved: one’s actions, character, or other evaluable attributes fall short of one’s values and moral beliefs; one sometimes misjudges or is uncertain about what the right thing to do is in particular situations, given one’s values; one is uncertain about some fundamental moral questions or recognizes a possibility that some of one’s core moral beliefs and values are mistaken. We sketch why one might think that AI tools could be used to support moral improvement in those areas, and describe two types of assistance: preparatory assistance, including advice and training supplied in advance of moral deliberation; and on-the-spot assistance, including on-the-spot advice and facilitation of moral functioning over the course of moral deliberation. Then, we turn to some of the ethical issues that AEAs might raise, looking in particular at three under-appreciated problems posed by the use of AI for moral self-improvement: namely, reliance on sensitive moral data; the inescapability of outside influences on AEAs; and AEA usage prompting the user to adopt beliefs and make decisions without adequate reasons. This article argues that political injustices can arise from the distribution and character of our sexual desires and that we can be held responsible for correcting these injustices. It draws on a conception of structural injustice to diagnose unjust patterns of sexual attraction, which are taken to arise when socio-structural processes shaping the formation of sexual desire compound systemic domination and capacity-deprivation for the occupants of a social position. Individualistic and structural solutions to the problem of unjust patterns of sexual (...) attraction are assessed in the context of racialised sexual aversion, racial fetishism, and the desexualisation of people with disabilities. While both forms of intervention can help in principle, some of the advantages of structural approaches are laid out. A schema for assigning political responsibilities for addressing this injustice is proposed, with some limits identified to the kinds of state and social responses that are justified. Finally, the status of the merely aesthetically unappealing is considered, with a relational egalitarian approach concluding that they are subject to structurally unjust patterns of sexual desire only when exposed to oppression or second-class citizenship as a result. R&D collaborations between industry, government, civil society, and research ) have recently gained attention from R&D theorists and practitioners. In aiming to come to grips with their complexity, past models have generally taken a stakeholder-analytical approach based on stakeholder types. Yet stakeholder types are difficult to operationalise. We therefore argue that a processual model is more suited for studying the interaction in QHCs because it eschews matters of titles and identities. We develop such a model in which the QHC is (...) represented as a process of generating four types of value: research value, market value, political value, and societal value. We then apply this processual model in analysing real-life cases of friction in QHCs. Friction is seen, not as an interpersonal clash, but as a discrepancy between two or more value-creation processes that compete for limited resources. (shrink)

We generally accept that medicine’s conceptual and ethical foundations are grounded in recognition of personhood. With patients in vegetative state, however, we’ve understood that the ethical implications of phenomenal consciousness are distinct from those of personhood. This suggests a need to reconsider medicine’s foundations. What is the role for recognition of consciousness (rather than personhood) in grounding the moral value of medicine and the specific demands of clinical ethics? I suggest that, according to holism, the moral value of medicine is (...) secured when conscious states are recognized in everyday medical science. Moreover, consciousness fully motivates traditional principles of clinical ethics if we understand respect for autonomy as respect for the dominion of an experiencer in the private, inescapable realm of bodily experience. When medicine’s foundations are grounded in recognition of consciousness, we understand how patients fully command respect even when they lack capacity to exercise their bodily dominion through decision-making. Cameras, microphones, and other sensors continue to proliferate in the world around us. I offer a new metaphor for conceptualizing these technologies: they are _digital wormholes_, transmitting representations of human persons between disparate points in space–time. We frequently cannot tell when they are operational, what kinds of data they are collecting, where the data may reappear in the future, and how the data can be used against us. The wormhole metaphor makes the mysteriousness of digital sensors salient: digital sensors have (...) brought us to a strange place. If humans are to be capable of making sensible decisions while under observation by digital sensors, we must improve the epistemic position of potential sensor subjects. (shrink)

Each of the standard outlooks in the philosophy of perception --phenomenalism, direct realism, indirect realism, scepticism -- has thus been viewed as Hume's own considered position in the eyes of informed commentators. I argue that Hume does not ascribe univocally to any one of the traditional stances in the philosophy of perception, nor does he leave us only a schizophrenic or 'mood' scepticism. Hume attempted to resolve the traditional philosophical problem (or perhaps more accurately, to set it aside on principled (...) grounds) by transforming the issue from one of theoretical consistency to one of pragmatic coherence. Hume's moderate scepticism and his systematic naturalism entail a reflective 'return' to the vulgar (cp. T 223), a qualified normative endorsement of the directly realist beliefs of common life. The interpretive challenge is to understand the subtle nature of that endorsement, and to explain how it arises out of genuinely Humean doctrines. The account offered here attempts both to capture Hume's own considered position and to explain the attractions and shortcomings of each of the competing interpretations. After laying out the elements of Hume's account of perceptual belief (section I), I proceed to examine in some detail two recent attempts to interpret Hume as a realist (sections II-III). I contend that these revisionary accounts ascribe unHumean doctrines to Hume. The interpretation of Hume as an irreducible 'mood' sceptic or as a phenomenalist are in that respect both closer to the mark, but Hume's reflective return to the vulgar has recast the nature of the problem and leaves us with a position that is not reflected in the more traditional interpretations (section IV). Socialist republicans advocate public ownership and control of the means of production in order to achieve the republican goal of a society without endemic domination. While civic republicanism is often attacked for its conservatism, the relatively neglected radical history of the tradition shows how a republican form of socialism provides powerful conceptual resources to critique capitalism for leaving workers and citizens dominated. This analysis supports a programme of public ownership and economic democracy intended to reduce domination in the workplace and (...) wider society. I defend this socialist republicanism from both the Marxist objection that it overlooks the impersonal nature of domination under capitalism and the left-liberal objections that property-owning democracy or worker codetermination are sufficient to suppress dominating relationships. The resulting position identifies the need for more ambitious institutional grounds for republican liberty than is often supposed, while offering us a distinctive emancipatory justification for socialism. It is widely accepted that we are answerable in a special way for our intentional actions. And it is also widely accepted that we are thus answerable because we perform intentional actions for reasons. The aim of this chapter is to argue against this ‘reasons’ view of such answerability. First, reasons are distinguished from practical standards. Then, it is argued that the best interpretation of the practices in which we treat agents as answerable is that they fundamentally concern practical standards (...) rather than reasons. This view shows that we are answerable, not just because we are deliberators, but because we are executive agents whose complex executive capacities open us to criticism. (shrink)

To hold an environmental ethic is to hold that non-human beings and states of affairs in the natural world have intrinsic value. This seemingly straightforward claim has been the focus of much recent philosophical discussion of environmental issues. Its clarity is, however, illusory. The term ‘intrinsic value’ has a variety of senses and many arguments on environmental ethics suffer from a conflation of these different senses: specimen hunters for the fallacy of equivocation will find rich pickings in the area. This (...) paper is largely the work of the underlabourer. I distinguish different senses of the concept of intrinsic value, and, relatedly, of the claim that non-human beings in the natural world have intrinsic value; I exhibit the logical relations between these claims and examine the distinct motivations for holding them. The paper is not however merely an exercise in conceptual underlabouring. It also defends one substantive thesis: that while it is the case that natural entities have intrinsic value in the strongest sense of the term, i.e., in the sense of value that exists independently of human valuations, such value does not as such entail any obligations on the part of human beings. The republican ideal of non-domination identifies the capacity for arbitrary interference as a fundamental threat to liberty that can generate fearful uncertainty and servility in those dominated. I argue that republican accounts of domination can provide a powerful analysis of the nature of legal and institutional power that is encountered by people with mental disorders or cognitive disabilities. In doing so, I demonstrate that non-domination is an ideal which is pertinent, distinctive, and desirable in thinking through psychological disability. Finally, I (...) evaluate republican strategies for contesting domination, focusing on the limits of contestatory democracy, and proposing a participatory alternative which better addresses problems of political agency in the mentally disordered and cognitively disabled. Biomedical diagnostic science is a great deal less successful than we've been willing to acknowledge in bioethics, and this fact has far-reaching ethical implications. In this article I consider the surprising prevalence of medically unexplained symptoms, and the term's ambiguous meaning. Then I frame central questions that remain answered in this context with respect to informed consent, autonomy, and truth-telling. Finally, I show that while considerable attention in this area is given to making sure not to provide biological care to (...) patients without a need, comparatively little is given to the competing, ethically central task of making sure never to obstruct access to biological care for those with diagnostically confusing biological conditions. I suggest this problem arises from confusion about the philosophical value of vagueness when it comes to the line between biological and psychosocial needs. (shrink)

A minimal truthmaker for a given proposition is the smallest portion of reality which makes this proposition true. Minimal truthmakers are frequently mentioned in the literature, but there has been no systematic account of what they are or of their importance. In this article we shall clarify the notion of a minimal truthmaker and argue that there is reason to think that at least some propositions have minimal truthmakers. We shall then argue that the notion can play a useful role (...) in truthmaker theory, by helping to explain the truth of certain propositions as precisely as possible. (shrink)

This article uses sim-max games to model perceptual categorization with the goal of answering the following question: To what degree should we expect the perceptual categories of biological actors to track properties of the world around them? I argue that an analysis of these games suggests that the relationship between real-world structure and evolved perceptual categories is mediated by successful action in the sense that organisms evolve to categorize together states of nature for which similar actions lead to similar results. What is distinctive about Lucretius’s version of Epicureanism? The answer might appear to be “nothing,” for two reasons. First, Epicureanism in general is doctrinally conservative, with followers of Epicurus claiming to follow his authority. Second, Lucretius claims to be merely transmitting the arguments of his beloved master Epicurus in a pleasing manner. I argue that these considerations do not prevent De Rerum Natura from presenting a distinct version of Epicureanism. Its arguments in physics are almost certainly drawn from Epicurus himself. (...) But in the examples Lucretius uses to illustrate these arguments, as well as in his descriptions of things like the fear of death and the formation of society, Lucretius delivers unexpected insights into human psychology, ones not clearly present in the other sources we have on Epicureanism. Furthermore, the way in which Lucretius presents his arguments can rightly be considered original philosophically and not just poetically. (shrink)

This article undertakes a republican analysis of power in the workplace and labour market in order to determine whether workers are dominated by employers. Civic republicans usually take domination to be subjection to an arbitrary power to interfere with choice. But when faced with labour disputes over what choices it is normal for workers to make for themselves, these accounts of domination struggle to determine whether employers possess the power to interfere. I propose an alternative capabilitarian conception of domination as (...) the arbitrary power to determine access to capabilities necessary for relationships of equality between citizens. This approach allows us to diagnose domination in the workplace and the labour market but does not capture unfreedom arising from the wider socio-structural position of workers. Thus, I supplement this capabilitarian account of the domination of workers with a structural account of dominating power, which reveals a richer set of conditions under which employers dominate workers. Trust not only disposes us to feel betrayed, trust can be betrayed. Understanding what a betrayal of trust is requires understanding how trust can ground an obligation on the part of the trusted person to act specifically as trusted. This essay argues that, since trust cannot ground an appropriate obligation where there is no prior obligation, a betrayal of trust should instead be conceived as the violation of a trust-based obligation to respect an already existing obligation. Two forms of trust (...) are evaluated for their potential to ground such a second-order obligation. One form counts as a gift to the trusted person only because it does not involve an expectation of trustworthiness; the other form cannot count as a gift but confers an honor because it does include an expectation of trustworthiness. Only trust that confers an honor generates a second-order obligation whose violation would be a betrayal of trust. -/- . (shrink)

This article challenges the individualism and neutrality of modern moral conscience. It looks to the history of the concept to excavate an older tradition that takes conscience to be social and morally responsive, while arguing that dominant contemporary justifications of conscience in terms of integrity are inadequate without reintroducing these social and moral traits. This prompts a rethinking of the nature and value of conscience: first, by demonstrating that a morally-responsive conscience is neither a contradiction in terms nor a political (...) absurdity; second, by suggesting how a morally-responsive conscience can be informed by the social world without being a mere proxy for social power or moribund tradition. This paper addresses ways of arguing fors ome form of economic democracy from within a broadly Rawlsian framework. Firstly, one can argue that a right to participate in economic decision-making should be added to the Rawlsian list of basic liberties, protected by the first principle of justice. Secondly,I argue that a society which institutes forms of economic democracy will be more likely to preserve a stable and just basic structure over time, by virtue of the effects of economic democratization on (...) the development of an active, democratic character among citizens. Thirdly, I argue that a proper understanding of the demands of the difference principle shows that justice demands more than ex post redistribution, but also requires the ex ante redistribution of power and authority in economic life. This connects to Rawls’s discussion of the badness of inequality, and to his endorsement of a “property-owning democracy”. -/- My conclusion is that, even if we may doubt the success of this first Rawlsian argument,the second and third arguments are both successful, and together establish a strong Rawlsian case forseeing economic democratization as a requirement of justice. Radical constructivists appeal to self-legislation in arguing that rational agents are the ultimate sources of normative authority over themselves. I chart the roots of radical constructivism and argue that its two leading Kantian proponents are unable to defend an account of self-legislation as the fundamental source of practical normativity without this legislation collapsing into a fatal arbitrariness. Christine Korsgaard cannot adequately justify the critical resources which agents use to navigate their practical identities. This leaves her account riven between rigorism and (...) voluntarism, such that it will not escape a paradox that arises when self-legislation is unable to appeal to external normative standards. Onora O'Neill anchors self-legislation more firmly to the self-disciplining structures of reason itself. However, she ultimately fails to defend sufficiently unconditional practical norms which could guide legislation. These endemic problems with radical constructivist models of self-legislation prompt a reconstruction of a neglected realist self-legislative tradition which is exemplified by Christian Wolff. In outlining a rationalist and realist account of self-legislation, I argue that it can also make sense of our ability to overcome anomie and deference in practical action. Thus, I claim that we need not make laws but can make them our own. (shrink)

Over 1000 companies have either curtailed or else completely ceased operations in Russia as a response to its invasion of Ukraine, a mass corporate exodus of a speed and scale which we’ve never seen. While corporate withdrawal appears to have considerable public support, it’s not obvious that it has done anything to hamper the Russian war effort, nor is it clear what the long-run effects of corporate withdrawal as a regularised response to war might be. Given this, it’s important the (...) evaluate the ethical merits of such a response. In this paper I critique what I take to be the two most common arguments given in favour of voluntary corporate withdrawal, which I label ‘the instrumental argument’ and ‘the clean hands argument’ respectively. After illustrating their shortcomings, I reframe corporations’ predicament as a ‘spattered hands’ case—one where they may do good by remaining in a war-waging state, but where they contribute indirectly to grave wrongdoing by doing so. Drawing on ideas from the ‘Business for Peace’ and ‘Business and Human Rights’ literature, I highlight the potentially positive role of corporate presence within war-waging countries, before highlighting four considerations which corporations ought to bear in mind when determining whether to withdraw, or whether it is the lesser evil to stay and to let their hands be spattered. It is widely thought that functionalism and the qualia theory are better positioned to accommodate the ‘affective’ aspect of pain phenomenology than representationalism. In this paper, we attempt to overturn this opinion by raising problems for both functionalism and the qualia theory on this score. With regard to functionalism, we argue that it gets the order of explanation wrong: pain experience gives rise to the effects it does because it hurts, and not the other way around. With regard to the (...) qualia theory, we argue that it fails to capture the sense in which pain 's affective phenomenology rationalises various bodily-directed beliefs, desires, and behaviours. Representationalism, in contrast, escapes both of these problems: it gets the order of explanation right and it explains how pain 's affective phenomenology can rationalise bodily-directed beliefs, desires, and behaviours. For this reason, we argue that representationalism has a significant advantage in the debates about pain 's affective phenomenology. We end the paper by examining objections, including the question of what representationalists should say about so-called ‘disassociation cases’, such as pain asymbolia. (shrink)
